Terms & Conditions

This page (together with the documents referred to on it) tells you the terms and conditions (“Terms & Conditions”) on which we supply any of the products (“Products”) listed on our website www.vivapatches.com (the “Site”) to you. The Products listed on the Site may be supplied directly by Vivapatches.

Please read these Terms & Conditions carefully before ordering any Products from the Site. By ordering any of our Products, you agree to be bound by these Terms & Conditions. You can print a copy of these Terms & Conditions by selecting the print option from your browser. Please also note that the use of the Site is subject to the Website Terms of Use, which apply whether or not you order any Products from the Site.

We take privacy seriously. The categories of personal data that we process depend on how you use our services. We use your personal data to provide purchases and services, to deal with your requests, to contact you regarding tailored products and services which may be of interest to you, to provide prize draws or competitions, or to carry out relevant administrative services. Information about us

The Site is operated by Vivapatches (“we” / “us”). Vivapatches is a company registered in the United States.

How the contract is formed between you and us

2.1 You may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts. You will have an opportunity to check and correct any input errors before submitting your order by clicking the “Proceed to Secure Payment” button.
2.2 After placing an order, you will receive an e-mail acknowledging receipt of your order and providing an order number and summary. This does not mean your order has been accepted. Your order constitutes an offer to us. All orders are subject to acceptance, which will be confirmed by an e-mail that the Product has been dispatched (“Dispatch Confirmation”). The contract between us is formed when we send the Dispatch Confirmation.
2.3 Each Contract relates only to those Products confirmed in the Dispatch Confirmation.
2.4 We may choose not to accept your order for any reason and will not be liable to you or anyone else in those circumstances.
2.5 We may be unable to process your order if the Product is out of stock/discontinued, or if there is a payment authorisation issue.
2.6 Certain Products may be subject to age restrictions by law. By using the Site and/or purchasing Products, you confirm that all information provided (including date of birth) is complete and accurate.

Delivery

3.1 We will deliver the Products according to the delivery option you select when placing your order.
3.2 All Products supplied by us in your order will be dispatched together, although they may arrive in multiple packages. Delivery will be to the address specified in your order.
3.3 For certain bulky or heavy items, additional delivery charges may apply.

Risk and Ownership

4.1 Once delivered, the Products become your responsibility. We will not be liable for loss, damage, or destruction after delivery unless Products are faulty or incorrectly delivered.
4.2 Ownership passes to you once Products are delivered and full payment has been received.

Price and Payment

5.1 The price of Products will be as quoted on the Site, except in cases of obvious error.
5.2 Prices exclude delivery costs, which will be added during checkout.
5.3 Prices may change, but changes will not affect confirmed orders.
5.4 Payment must be made in full before your order can be completed. We accept major credit and debit cards.
5.5 By paying with a card, you confirm that it is yours. All card transactions are subject to validation checks and authorisation by the card issuer. If your payment is declined, we will not accept your order.
5.6 Despite our best efforts, errors may occur in pricing. If a Product’s correct price is higher than shown, we may contact you before dispatch or reject your order.

Cancellation, Returns and Refunds

6.1 You may cancel your order at any time before dispatch, and up to 28 days after receipt. To cancel, contact us at hello@vivapatches.com.
6.2 Exceptions: you cannot cancel if Products are perishable, medicines, personalised, sealed items unsealed after delivery, or hygiene-sensitive items (e.g. earrings) unless faulty or incorrectly delivered.
6.3 Products must be returned at your own risk, unused (except where necessary to examine them), in original condition and packaging.
6.4 You are responsible for return shipping unless otherwise stated.
6.5 Once Products are returned, we will refund all sums paid (including standard delivery costs). Refunds will be processed within 14 days.
6.6 If Products are damaged, faulty, or incorrect, you are entitled to a refund, repair, or replacement in line with your statutory rights.

Our liability

7.1 We are under a legal duty to supply Products that conform with the contract.
7.2 We accept no liability for indirect or unforeseeable losses, including business losses such as lost profits or goodwill.
7.3 This does not exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under U.S. law.
7.4 You must follow any instructions provided with Products. We cannot accept liability for misuse.

Events outside our control

We will not be liable for delays or failures caused by events outside our reasonable control.

General

10.1 If any provision of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions remain in effect.
10.2 We may revise these Terms & Conditions at any time by updating them on the Site. Changes will not affect orders already placed.
10.3 Failure to enforce a right does not result in waiver.
10.4 These Terms & Conditions are governed by the laws of the United States, and any disputes shall be subject to the exclusive jurisdiction of the U.S. courts.
